Royalty Free Stock Photography

Royalty-Free means is that you pay for the Media only once and then you can use it in perpetuity and worldwide, with no restrictions. In other words, there are no license fees except the initial fee and no other royalties to be paid except those included in the initial cost. You are allowed to use the image for an unlimited number of copies, printed and/or electronic.

The Royalty-Free license is granted ONLY for the non-watermarked Media you buy using the License button; all the other versions (small watermarked and non-watermarked thumbnails which are visible on the public site) are entirely copyrighted save for those images deemed to be in the public domain. In those instances, the fee you pay is to cover the cost of supplying the image.

1. Copyright & Ownership
* Retention: The library/photographer retains the entire copyright and intellectual property in all images at all times, worldwide, as protected under the Copyright, Designs and Patents Act 1988.
* No Transfer: No intellectual property or ownership interest in the images is passed to the client upon purchase or download.

2. Licence & Permitted Use
* Scope of Use: Reproduction rights are strictly limited to the specific terms outlined in the invoice or licence agreement (e.g., one-time use, specific territory, duration, and media).
* Third Parties: Usage rights are personal to the client and cannot be sub-licensed, assigned, loaned, or transferred to any third party without prior written consent.

3. Payment & Invoicing
* Payment Terms: Standard payment is typically required immediately by credit card or, in the case of an account customer, within 30 days of the invoice date.
* Late Payments: The library reserves the right to charge statutory interest on late payments (e.g., as permitted under the UK Late Payment of Commercial Debts legislation).
* Suspension of Rights: No reproduction rights are granted until the invoice is paid in full. Unauthorized use before payment is treated as a copyright infringement.

4. Credit Lines
* Attribution: The client must include a credit line in the form specified by the library (e.g., "©Ian Dagnall/Digital Image Library") in close proximity to the published image.

5. Liability & Indemnity
* Client Responsibility: The client is responsible for obtaining any necessary model, property, or brand releases required for their specific use of the image.
* Indemnification: The client agrees to indemnify the photo library against any claims, damages, or costs arising from unauthorized use or a failure to secure proper clearances.

6. Archiving & Storage
* Digital Files: Clients may not store or archive the images electronically beyond the requirements of their licensed project without written permission.
